Terms of Service

1. General Provisions

1.1. These Terms of Service define the rules for using the services offered by Kliikstream, including the ad optimization API.

1.2. Kliikstream is a marketplace for internet advertisements that provides an API for ad optimization based on content context.

1.3. Using Kliikstream services implies acceptance of these Terms of Service.

2. Definitions

2.1. Service Provider - the entity providing services through the Kliikstream platform.

2.2. User - a natural person, legal entity, or organizational unit without legal personality using Kliikstream services.

2.3. API - application programming interface provided by Kliikstream, enabling ad optimization based on content context.

2.4. Account - User's individual access to Kliikstream services, secured with a unique login and password.

3. Terms of Use

3.1. Using the Kliikstream API requires creating an Account and obtaining an API key.

3.2. The User agrees to use Kliikstream services in accordance with their intended purpose, applicable law, and good practices.

3.3. It is forbidden to use the Kliikstream API for activities that are illegal, violate third-party rights, or are harmful to the Service Provider.

4. User Rights and Obligations

4.1. The User has the right to use the Kliikstream API in accordance with the purchased subscription.

4.2. The User is obligated to protect their API key from unauthorized access.

4.3. The User is responsible for all actions performed using their API key.

5. Service Provider Rights and Obligations

5.1. The Service Provider undertakes to ensure the availability of the Kliikstream API in accordance with the SLA (Service Level Agreement) terms.

5.2. The Service Provider reserves the right to temporarily limit access to services for maintenance purposes.

5.3. The Service Provider has the right to monitor API usage to ensure its proper functioning and security.

6. Liability

6.1. The Service Provider is not liable for damages resulting from improper use of the API by the User.

6.2. The Service Provider does not guarantee that the API will operate without errors and interruptions.

6.3. The Service Provider's liability towards the User is limited to the amount of fees paid by the User for using the services.

7. Complaints

7.1. The User has the right to submit complaints regarding the operation of Kliikstream services.

7.2. Complaints should be submitted electronically to support@kliikstream.com.

7.3. Complaints will be processed within 14 days from the date of receipt.

8. Changes to the Terms

8.1. The Service Provider reserves the right to change these Terms of Service.

8.2. Users will be informed about changes to the Terms with at least 14 days' notice.

8.3. Continued use of the services after the introduction of changes to the Terms implies their acceptance.

9. Final Provisions

9.1. In matters not regulated by these Terms, Polish law shall apply.

9.2. Any disputes arising from the use of Kliikstream services will be resolved by the court having jurisdiction over the Service Provider's registered office.

9.3. These Terms of Service come into effect on April 1, 2025.
